TERMS AND CONDITIONS

PREAMBLE

1. These general terms and conditions of sale are agreed between JANELAS ÉPICAS LDA, with registered office at Urbanização Quinta Verde 33, 2710-445 Nafarros Sintra, registered with NIF under number 516963910, hereinafter referred to as “ FLOW TO FITNESS ” and people who wish to make purchases through the website www.flowtofitness.pt hereinafter referred to as “User”.

2. The parties agree that purchases made through the website www.flowtofitness.pt will be regulated exclusively by this contract, excluding any conditions previously available on the website.

ARTICLE 1 – PURPOSE

1. The purpose of these general terms and conditions of sale is to provide and define all the information necessary for the User regarding the methods of ordering, selling, paying for and delivering purchases made on the website www.flowtofitness.pt.

2. These conditions regulate all the steps necessary to place the order and guarantee the follow-up of this order between the Contracting Parties.

ARTICLE 2 – ORDER

1. The User completes his/her order by completing the purchase process presented on the website www.flowtofitness.pt, adding the product(s) or service(s) he/she wishes to order to the shopping basket:

2. To send your order, the User must:

a) Register on the website www.flowtofitness.pt, providing the information requested there.

b) Log in (providing a combination of email and password chosen by the User when registering).

c) Complete the information and choose the options available to you throughout the order completion process (delivery and billing address, shipping method, payment method, as well as the NIF and name that, for tax purposes, you wish to appear on the invoice).

3. The final confirmation of the order by the User is equivalent to full and complete acceptance of the prices and description of the products available for sale as well as these General Conditions of Sale, which will be the only ones applicable to the contract thus concluded.

4. Flow to Fitness will honor orders received online only up to the limit of available stocks. If the product is unavailable, Flow to Fitness undertakes to inform the User as soon as possible.

5. The data contained in the invoice are the sole responsibility of the User. Once the invoice has been issued, it cannot be reissued with changes.

6. Orders are valid for 8 (eight) days, unless the order is registered under a promotional campaign that defines a different period. It is not possible to guarantee prices, discounts, promotions and offers beyond this period. If payment is not received by our services within the aforementioned period, the order cannot be validated. Any amount received after this date will be returned or used in a new order.

ARTICLE 3 – PAYMENT

1. On the website www.flowtofitness.pt, Flow to Fitness offers the User the following payment methods:

• Mbway, Multibanco Reference and Bank Transfer

2. In the case of payment by credit card, the User's card will be debited immediately after confirmation of dispatch of the goods. If some of the products ordered are out of stock, the value of these will be credited to the User's card after the order is closed.

ARTICLE 4 – DELIVERY

1. Orders will be delivered within 5 to 8 working days after placing the order. Delivery is carried out by CTT.

2. Shipping costs will be added to the order:

• Portugal (6 euros)
  CTT: Home delivery within 3 to 5 days (working days) unless out of stock

• Islands (Madeira and Azores) (10 euros)
  CTT: Home delivery 8 to 15 (working days) unless out of stock

• Europe(10 euros)
  CTT: Home delivery 8 to 15 working days (except if out of stock)

• Rest of the World (30 euros)
  CTT: fast home delivery 8 to 30 working days (except if out of stock)
  
  Free in Portugal and Islands for purchases over 60 euros

ARTICLE 5 – PRICE

1. Prices are to be understood in Euros, with taxes and fees included, taking into account the VAT in force on the date of payment of the order.

2. If there is an increase in the price of any product, the User will be informed immediately and may choose to receive their order (paying the difference) or cancel it.

ARTICLE 6 – CANCELLATION AND RETURN

1. The cancellation or refund process is handled on a case-by-case basis by Flow To Fitness.

2. After confirmation and payment of the order, returns or cancellations will not be accepted, except for proven reasons of product defect.

3. The request must be sent in writing to the general contact email address flowtofitness@gmail.com, up to 8 days after the order is dispatched, with the instructions for cancellation or return of the goods being responded to and defined by Flow to Fitness, using the same means of communication.

4. Whenever possible, the refund should be made using the same payment method, but if this is not possible, the user must present proof of payment and account or card ownership, so that the refund can be made by Bank Transfer.

5. Flow to Fitness undertakes to reimburse the User within a maximum period of 15 days.

6. Returned products must be in a saleable condition, that is, in the same condition in which they arrived in the User's hands, without any additional anomalies or damage.

7. If the value resulting from the exchange of products from an order is lower or higher than the initial value of the same, the settlement conditions will be indicated by Flow to Fitness.

ARTICLE 7 – PRIVACY POLICY

Your data is processed in compliance with the legislation on the protection of personal data. These data, subject to computer processing, will be included in the Flow to Fitness database(s) and are intended for the registration and presentation of other products and services, as well as institutional information, to be made available by the same.

Providing it is optional and, under the terms of the law, you are guaranteed the right to access, rectify and cancel any data that directly concerns you, in person or in writing, directly to the address on the home page of this website.
